movie deals and soundtracks

It is with great pride and at times, downright panic,  that I shout from the top of our sculptie roof the fabulous news that SL's one and only Winston Ackland penned a deal with 20th Century Fox for their movie opening Christmas Day, in the US and Feb/March elsewhere in the world.

We waited for several months for Courtney Love to sign yet another release for us and it is official, Winston's much loved bossa nova version of Kurt Cobain's Lithium will be appearing in the final cut of Marley & Me starring Jennifer Aniston and Owen Wilson.

Please keep an eye out for the movie and soundtrack.  Cool

This particular case is a mystery and a very welcome shocker. We have NO idea how they heard the song. They came to him and it was already decided they wanted it, they just needed him and C Love to sign.

However, there are several companies out there that do just this, promote music for movies, tv and commercials. Winston has now given his music, originals and covers to several of these types of companies since he has a resume of sorts and well, why not?!

If you want to get your music into a library or similar for   licencing out to films/media etc then you would need to submit your work to a music company/library or production music company whose role is to find the types of music that any director has in mind for his project.  

When a song is used in a film it is not only performed but also reproduced in copies. These are rights that come exclusively with copyright ownership. The film producer must obtain the proper licensing to use a song in an audio/visual production. This involves two separate copyrights: One for the underlying music which is owned by the publisher, and one in the specific recording of the music, which is owned by the record company. A synchronization license covers the right to use the music, and a master recording license covers the use of the music. Because films are made to be reproduced the filmmaker must obtain both.


Production music is music owned by production music libraries and licensed to customers for use in film, television, radio and other media.
These libraries own all of the copyrights of their music, meaning that it can be licensed without seeking the composer's permission, as is necessary in licensing music from normal publishers.  Production music is therefore  very convenient  for media producers - they can be assured that they will be able to license any piece of music in the library at a reasonable rate.

There are also Royalty Free libraries for customers to  search for music for media.
These libraries do not charge customers for licensing the music. Instead, the customers purchase a CD of music - priced typically between 50 and 300 dollars - whose content is licensed in perpetuity for them to synchronise as often they wish. These libraries depend mainly on performance royalties for their income (with a small amount of income from sales of physical CDs or online track downloads).

When you have had a piece of music accepted for a film/or other then you will also be giving permission for them to edit your work to fit a particular scene.. it may be as short as 10 second clip/ background music or if you are  lucky then you get  the whole track played although  that is usually  played at the beginning or  end ( credits).

thank you for the kind words.  as sesi said, we still don't know how the recording ended up on the cut, but we are happy it did.

this particular song is on a cd carried online by cdbaby (http://cdbaby.com).  someone from cdbaby contacted me to get my permission for use in the film.  it was then that i found out that cdbaby does have contacts with those who put music into commercials, tv shows and movies.  this is good news for anyone with a cd at cdbaby.

slim is correct about the permissions necessary to use the song.  in addition to getting my permission to use my recording of it, they also had to go to the publisher of the song to use the words and melody.  

so, the big money is if you can get your own recording of one of your own compositions in a film.  then you are talking huge.

in any event, it will be interesting to see what happens...

Fantastic Winston CONGRATS!!!!!

Maybe its time to do a couple Full CDs with some covers and get them up at CDBaby (I hope CD Baby stays, was reading they may sell, or close up Sad  )

CD Baby did officially sell this past summer, it had been in a 7 year partnership with Disc Makers and DM took over all aspects of CD Baby in August 08.

In our experience, operations have stayed pretty much the same. There have been a few growing pains for Disc Makers but I think that is to be expected in a take over of that size.

Winston and I are working on a way to tie in to his rl/sl identity with CD Baby and his websites. The hits and sales his CD Baby site has received since this article was published  (http://nwn.blogs.com/nwn/2008/10/new-world-new-1.html#more ) have been amazing. We wonder why we were so adamant about keeping rl and sl seperate, talk about boosting sl music profile. Laughing

No matter who owns it, it's a fantastic opportunity and resource for indie muscians. I think all sl musicians should consider CD Baby or other ways to tie their successes from one life to another.   Very Happy
